FDA Clearance Basics: Food

If you are importing food products into the United States, there are several steps

You need to take to ensure compliance with the Food and Drug Administration (FDA).

Here is what you need to do:

  1. Register with the FDA: Before you can import your food shipment, you need to register with the FDA. Both importers and food facilities in the exporting country must register. You can register on the FDA website.

  2. Obtain an Entry Identifier: Once you have registered, you will be given a seven-digit identifier. This code is required for FDA Prior Notice, which must be filed up to five days before your product arrives in the US.

  3. Determine the FDA Product Code: You need to determine the FDA Product Code for your product or group of products. The product code is a unique identifier used by the FDA. If you are unsure of your product code, the FDA has a product code builder on their website.

  4. File Prior Notice: With your FDA registration and product code in hand, you can now file your Prior Notice.

  5. Gather Additional FDA Information: To process your Customs clearance, you will need to provide additional information to the FDA. This includes the FDA product code, FDA Manufacturer Code (which can be found using the Customs MID), FDA Supplier Code (provided by your supplier), your Importer FEI Number Name (Federal Establishment Identifier), FDA Shipper Number (provided by the shipper), and the Manufacturer Processor FDA Number (provided by the manufacturer).

Once your Customs clearance has been filed and the required information has been transmitted to the FDA, your goods will be staged for an FDA exam. The FDA may choose to review the paperwork and release your shipment, or they may require a physical exam of the goods.

It is important to be informed and prepared. Please ensure you have all the necessary information and documentation at hand to ensure a smooth, transparent, and efficient clearance process.
